So, is Delta 8 Legal in Georgia?
In short, yes, delta 8 THC is legal in Georgia. But you probably want to know the “how” rather than just a yes or no answer. Don’t worry, we’re about to get much more in-depth.
What is Delta 8 THC?
This is a subject we’ve touched on much more in other blogs. We’ll give a quick summary here, though. Delta 8 THC is a less-potent form of THC, found in micro-percentages in various cannabis strains.
Since it’s a type of THC, it can definitely get you high — but not like the delta 9 THC in marijuana can. It’s not as potent, so it’s not as strong. Many delta 8 users see this as a benefit, however.
The intensity from the high in marijuana can sometimes cause negative symptoms in users. Anxiety, paranoia, panic attacks, and more are downright unavoidable for some people. When they make the switch to delta 8, the negative symptoms fade away.

As of September 2020, delta 8 is legal in Georgia. The state aligns their laws with federal law. The federal law, based on the 2018 Farm Bill, legalizes industrial hemp and all its derivatives. That happens to include delta 8, a derivative of hemp.
As long as the delta 8 comes from legal, industrial hemp, it’s completely legal in Georgia. However, delta 8 can also be present in minor amounts in marijuana. Delta 8 extracted from marijuana is not legal.

Is Delta 8 Federally Legal?
Again, thanks to the 2018 Farm Bill, delta 8 from hemp is absolutely federally legal. Hemp and any derivative are legal as long as it contains 0.3% or less delta 9 THC on a dry-weight basis. As it happens, delta 8 is a completely different compound. Since it’s not delta 9 THC, a delta 8 product that derives from hemp is fully legal.
