According to state law, delta 8 is legal in Tennessee. But we want to give you more than just a yes or no answer! We want to show you the actual laws defining delta 8 as legal within Tennessee state lines. Is delta 8 legal in Tennessee? Yes, but we’re going to dive into detail as to how and why.


When Did Delta 8 Become Legal?

As we’ve explained in past blogs, delta 8 THC is legal through the 2018 Farm Bill. Industrial hemp was made legal through the hemp act within the Farm Bill. This also brought forth an entirely new definition for hemp, in the first place. Hemp is any cannabis plant that contains no more than 0.3% delta-9 THC.

Now, what the Farm Bill did was make it to where states got to decide if they would have their own hemp plan or not. Tennessee, as it so happens, jumped on this. Since then, they’ve made specifications in their laws towards hemp and its derivatives. So, is delta 8 legal in Tennessee? Absolutely it is!


Is Delta 8 Legal in Tennessee?

Tennessee follows the Federal Register’s final rule, which went into law officially on January 15, 2021.

The 301-page bill mentions delta 8 THC 10 times (you can check it out yourself here). In those 10 times, the bill clarifies that delta 8 only exists in trace amounts in marijuana. 

Essentially, if delta-9 THC cannot be more than 0.3% of the overall hemp plant on a dry-weight basis, delta 8 is roughly 0.0003%. It contributes such a small part to the overall plant, it is insignificant, and “contributes nothing significant to the total THC content.”

The bill goes on to further clarify that delta 8 is rarely included in total THC calculations. Many labs don’t even test for it. As such, delta 8 THC is unrelated to the 0.3% delta-9 THC limit. 

So what does all this fancy lingo mean? Is delta 8 legal in Tennessee completely? Well, everywhere has its conditions and regulations. For Tennessee, however, they clarify that they only care about the limit of delta-9 THC in hemp-based products. 

In conclusion: a delta 8 THC product that contains 0.3% delta-9 THC or less is still 100% legal in the state of Tennessee.
