Technically, the 2018 Farm Bill legalized much more than just hemp for sale and consumption. All of hemp’s derivatives, except for 0.3% delta-9 THC or more, were made legal. That means delta-8, a completely different form of THC, wasn’t defined as an illegal form of THC in the bill.

Now, some states have changed their own laws to further clarify. For example, Louisiana recently proposed a law that would cover any form of THC concentration. That means regardless of the form of THC, it must not be more than 0.3% on a dry-weight basis.
