Things are changing up quickly in the great state of MS quickly, especially in regards to delta 8, so let’s dive in with what we know. 

It’s important to mention before we begin that Mississippi hasn’t always been the most cannabis-friendly of states. In fact, the state now has updated hemp and cannabis laws in just the last few years. As a result, when asking is delta 8 legal in Mississippi, the answer is a fortunate yes.


Is Delta 8 Legal in Mississippi?

When the 2018 Farm Bill legalized industrial hemp, states got to decide whether they would roll out their own hemp plan or not. In Mississippi, they decided to basically mirror the 2018 Farm Bill. They legalized hemp and all its derivatives up to 0.3% delta-9 THC. In fact, new legislation for Mississippi specifically removed hemp materials from the state’s list of Controlled Substances.

Is Delta 8 a Controlled Substance in Mississippi?

Mississippi legalized hemp for agricultural use after the 2018 Farm Bill. Within their new laws, they also added this to their Controlled Substances Act:

“Hemp, as defined and regulated under Sections 1 through 11 of this act and Cannabidiol contained in a legend drug product approved by the Federal Food and Drug Administration or obtained under Section 41-29-136 * * *, are exempt under Schedule I);”

This means that, specifically according to Mississippi’s own laws, delta 8 when derived from hemp is completely legal. Our delta 8 products match this requirement. Is Weed Legal in Mississippi?
