It’s important to mention before we begin that Mississippi hasn’t always been the most cannabis-friendly of states. In fact, the state now has updated hemp and cannabis laws in just the last few years. As a result, when asking is delta 8 legal in Mississippi, the answer is a fortunate yes.
Is Delta 8 Legal in Mississippi?
When the 2018 Farm Bill legalized industrial hemp, states got to decide whether they would roll out their own hemp plan or not. In MI’s, they decided to basically mirror the 2018 Farm Bill. They legalized hemp and all its derivatives up to 0.3% delta-9 THC. In fact, new legislation for Mississippi specifically removed hemp materials from the state’s list of Controlled Substances.
However, we do want to say that laws are subject to change at any time. Make sure you do your own research outside of this blog to verify all information you find. We never attempt to make legal advice, we simply observe the current laws at hand.
Is Delta 8 a Controlled Substance in Mississippi?
Mississippi legalized hemp for agricultural use after the 2018 Farm Bill. Within their new laws, they also added this to their Controlled Substances Act:
“Hemp, as defined and regulated under Sections 1 through 11 of this act and Cannabidiol contained in a legend drug product approved by the Federal Food and Drug Administration or obtained under Section 41-29-136 * * *, are exempt under Schedule I);”
This means that, specifically according to Mississippi’s own laws, delta 8 when derived from hemp is completely legal. Our delta 8 products match this requirement. We derive our delta 8 naturally from hemp plants in mass and ensure the utmost quality and accuracy. Lab-tested through a third-party lab afterward, our products are effective and potent.
Is Weed Legal in Mississippi?
Initiative 65 was set to legalize medical weed for MI. The bill helps countless residents with chronic or debilitating conditions. In May 2021, the Supreme Court decided to overturn this decision. Mary Hawkins Butler, the mayor for Madison, MI, is the one who petitioned for it to be overturned in the first place.
What does that mean for citizens? Unfortunately, legal weed is still on the horizon for MI residents. On the bright side, delta 8 and other hemp-based products are still fully – and legally – on the table.
